What am I responsible for if something goes wrong?

As an independent professional, you're responsible for your own work. Here's what the Talent Terms of Service say, in plain English.

What you cover (Section 8)

You agree to defend and cover Go Fractional, including reasonable legal fees, for claims that arise from:

  • Your acts or omissions under the agreement, including a breach of anything you've represented or committed to
  • A claim that your services, deliverables, or work product infringe someone else's rights
  • Go Fractional's or the client's use of your services or deliverables
  • Your gross negligence, willful misconduct, or fraud
  • Your relationship with the client

The exception: this doesn't apply to the extent a claim relates to or arises from Go Fractional's own willful misconduct or gross negligence.

Go Fractional's liability to you (Section 9)

Go Fractional isn't liable for indirect or consequential damages, such as lost profits or lost revenue, and its total liability under the agreement is limited to the fees due to you. This limit doesn't apply to the confidentiality and indemnification obligations in the terms.

Taxes

As an independent contractor you're responsible for your own taxes, and you agree to cover Go Fractional if a tax authority claims otherwise (Section 4).
