What are my confidentiality obligations?

During an engagement you'll likely see sensitive client information: code, strategies, designs, financials, customer details, and more. Under the Talent Terms of Service, you agree to:

  • Protect it in a commercially reasonable way, and at least as carefully as you protect your own confidential information.
  • Tell the client immediately if you learn that any of it has been lost or disclosed.
  • Share only what's legally required if a law or court order ever compels you, and promptly let the client know so they can respond.

The same duties apply to Go Fractional's own confidential information, and they continue after your engagement ends.

What doesn't count as confidential

Information that's publicly known, that you lawfully got from another source, or that you developed independently.

Will the client ask me to sign a separate NDA?

Usually not, because confidentiality is already built into your Go Fractional agreement. See Will I need to sign additional agreements directly with a client?
